Definitions
In these terms, the following definitions apply:
- Coach refers to Amy Brink-Peterson, trading as Coach Amy.
- Coachee refers to the individual receiving coaching services.
- Client refers to the person or organization entering into a financial agreement with Coach Amy. For private arrangements, the Client and Coachee are the same person. For corporate arrangements, the Client is the organization funding the coaching on behalf of the Coachee.
- Program refers to the coaching package agreed upon between the Coach and the Client.
The Scope of Coaching and the Role of the Coach
Coaching is a relationship and a collaborative process between the Coach and the Coachee that is designed to facilitate the development of personal or professional goals of the Coachee and develop a plan/strategy for achieving those goals.
The coaching experience helps the Coachee to establish new behaviors and grow personally and/or professionally. Coaching is a comprehensive process, which may involve all areas of the Coachee's life, including work, family, health, relationships, education and recreation.
The Coachee acknowledges that deciding how to handle any issues is their responsibility. The Coachee understands that they are fully responsible for the decisions and choices reached during the coaching sessions.
The coaching relationship is strengths-based, forward-looking, and collaborative. The coaching agenda is developed and implemented in partnership between the Coachee and Coach.
The role of the Coach is to support the Coachee towards achieving a goal.
The Coachee and Coach agree to engage fully in the coaching experience. Both parties agree to commit to the coaching sessions to facilitate the Coachee's desired change.
The Coachee is aware that results are not guaranteed. The Coachee enters into the coaching relationship with the full understanding that they are entirely responsible for creating their results, whether in their business or personal life.
The Coachee recognizes that coaching is not a substitute for therapy, counseling, substance abuse treatment, any other form of healthcare, or consulting.
The Coachee promises to inform the Coach if they are currently in any kind of therapy, and that any medical or therapeutic practitioners involved in their care have been advised of their intention to work with a coach.
Session Timing and (Re)scheduling
The first session is scheduled as soon as possible after the program begins.
Coaching sessions are scheduled in advance through the Practice Better online scheduling tool. It is the responsibility of the Coachee to pre-schedule all sessions before the program end date. A program expires if sessions have not been completed within the end date specified in the Practice Better portal. Unused sessions will be forfeited and no refunds will be given.
Within the Practice Better portal, scheduled sessions can be indicated as "Confirmed" or "Unconfirmed". When a session is marked as "Confirmed", this indicates that both parties have agreed to this appointment. When a session is marked as "Unconfirmed", this appointment is still a request from one party to another. Both parties agree to confirm or deny any scheduling requests at their earliest convenience.
Rescheduling or cancellations of agreed-upon appointments should be done at least 48 hours before the planned date. The Coach sets aside session time specifically for the Coachee, prepares for it in advance, and values the time together. The Coachee is requested to respect this and to carve out the agreed time. The Coach understands that sometimes unforeseen things do arise, and the Coachee may need to reschedule or cancel a session. Where possible, the Coachee is requested to give the Coach a minimum of 48 hours' notice.
It is very rare for the Coach to run late for a session, but should this occur, the Coach will endeavor, with the Coachee's permission, to extend the session time. If the Coach is more than 10 minutes late and the Coachee is unable to stay longer, a coaching session will be added to the coaching agreement. If the Coach misses a session without providing prior notice, a coaching session will also be added to the coaching agreement.
If the Coachee is late for an appointment, it is unlikely that the Coach will be able to extend the session time due to other pre-existing commitments. If the Coachee is going to be more than 10 minutes late, the Coachee is requested to inform the Coach with as much notice as possible.
If the Coachee is more than 10 minutes late to a session and provides no prior notice, the session will be considered as having taken place and will not be made up.
After 2 missed sessions without prior notice from the Coachee, the Coach may choose to pause the package and remove all remaining sessions from the schedule. The Coach will reach out to the Coachee to address what has been hindering them to show up for sessions, and to reschedule the sessions in a way that meets the needs of both parties. If there is no response from the Coachee during the remainder of the program period (as indicated in Practice Better), or if the Coachee misses 3 consecutive sessions without prior notice, the coaching package will be terminated with no refunds given.
Session Location
Unless otherwise agreed upon, sessions occur through video conference. Depending on what works best for both the Coach and the Client, coaching sessions may also occur in person or by phone upon request.
Support and Communication Between Sessions
On occasion, the Coachee may have an urgent question, request for feedback, want to share a celebration, or want a confidential response to some situation where they don't want to wait for the next session. In this case, the Coachee can log in to the private client portal in Practice Better and communicate with the Coach to get a timely response between sessions. The Coach will endeavor to respond within 24 hours (with the exception of weekends, public holidays, and vacation periods).
Disclaimer of Healthcare-Related Services and Limitations of the Coaching Relationship
The Coach encourages the Coachee to continue to visit and to be treated by their healthcare professionals, including, without limitation, a physician. The Coachee understands that the Coach is not acting in the capacity of a doctor, dietitian, psychologist, or other licensed or registered professional. Accordingly, the Coachee understands that the Coach is not providing healthcare, medical, or nutrition therapy services and will not diagnose, treat, or cure in any manner whatsoever any disease, condition, or other physical or mental ailment of the human body. The focus of the Coach is on supporting behavior change necessary to meet the Coachee's goals.
The Coach's expertise is to support the Coachee from where they are now to where they want to be. Along the way, the Coachee may find parts of the coaching series personally challenging. This is normal and part of the process. The Coachee may also experience temporary "negative" feelings such as sadness, anger, guilt, disappointment, or anxiety, which should transform throughout the coaching work as the Coachee learns to be more self-compassionate and self-loving.
The Coach's role is to listen, guide, and support the Coachee towards desired behavior change in a safe and non-judgmental space. The Coachee alone is responsible for their emotional and mental well-being; however, should negative feelings persist or should the Coachee find themselves overwhelmed by them, they will need to seek other forms of support or professional help. This is very rare, but if it does happen, the Coach is happy to discuss referrals with the Coachee.
Problems or Concerns
If the Coach ever says or does anything in a session that the Coachee doesn't feel comfortable with, or if the Coachee has any concerns with the way the coaching is progressing, the Coachee is requested to let the Coach know as soon as possible. For the work together to be effective, it is important that the Coachee feels heard and that there is an open and honest relationship between both parties. The Coach will also communicate any concerns to the best of her ability.
Confidentiality
The Coach recognizes that anything the Coachee shares is regarded as "Confidential Information", whether it is business or personal information. The Coach undertakes not to, at any time (unless required to do so by law), either directly or indirectly, use or disclose any information the Coachee shares with her during their sessions.
This confidentiality also applies to testimonials, which the Coach may use for promotional reasons only with the consent of the Coachee. The Coachee may request anonymity in connection with any testimonials to be used.
"Confidential Information" does not include information that is:
a) previously known to the Coach prior to discussions regarding this agreement, free from any obligation to keep it confidential, or
b) publicly disclosed by the Coachee either prior to or subsequent to the receipt by the Coach of such information, or
c) independently developed by the Coach without any access to Confidential Information, or
d) rightfully obtained by the Coach from a third party lawfully in possession of Confidential Information who is not bound by confidentiality obligations to the Coachee.
Coaching Confidentiality for Organizationally Funded Programs
Where coaching is funded by an organization on behalf of the Coachee, the content of all coaching sessions remains strictly confidential between Coach Amy and the Coachee. Coach Amy will not share session content, session notes, or any personal information disclosed by the Coachee with the funding organization, its employees, or any third party, except where required to do so by law.
Organizations funding a coaching program acknowledge that they are not entitled to request reports, updates, or information about the content of coaching sessions. Coach Amy may confirm to the organization that sessions are taking place, but will share no further detail without the explicit written consent of the Coachee.
This confidentiality protection is a fundamental condition of the coaching relationship.
Payment
Coach Amy accepts payment via bank transfer, or as otherwise detailed on the invoice.
Private clients:
Upon acceptance of a coaching proposal or offer, the Coachee will receive an invoice from Coach Amy. The program begins upon receipt of payment.
Private clients may request a payment plan. A 10% surcharge applies to payment plan arrangements. If a payment plan is selected, the Coachee agrees to pay according to the schedule provided. In the event of a missed payment, Coach Amy reserves the right to pause access to the program, including sessions and the client portal, until the outstanding amount has been received. If payment is not made within 30 days of the due date, Coach Amy reserves the right to terminate the agreement.
Corporate clients:
Where coaching is funded by an organization, the program is confirmed upon receipt of the signed coaching proposal. An invoice will then be issued to the organization, with payment due within 30 days of the invoice date. Coaching sessions will be scheduled once the proposal has been signed, unless otherwise agreed in writing.
Refund Policy
Private clients:
Private clients have the right to withdraw from this agreement within 14 days of making the (first) payment, without giving any reason, in accordance with applicable Dutch and EU consumer protection law. To exercise this right, the Coachee must notify Coach Amy in writing at hello@coachamy.nl within this 14-day period.
If the Coachee explicitly requests that coaching begin before the 14-day withdrawal period has expired, the Coachee acknowledges that by doing so they waive their right of withdrawal once the first session has taken place. In that case, a proportional refund will be issued for any part of the program not yet delivered.
If the Coachee does not request an early start, the 14-day withdrawal period applies in full. A full refund will be issued if the agreement is cancelled within this period.
After the 14-day withdrawal period has expired and/or the first session has taken place, no refunds will be issued. Should unforeseen circumstances arise that prevent the Coachee from continuing, the Coach may decide to partially refund at her discretion.
Corporate clients:
No refunds are issued once the coaching proposal has been signed. The organization acknowledges that Coach Amy will reserve time and prepare for the program upon signing, and that the investment reflects this commitment.
In the event that Coach Amy is unable to deliver the program due to circumstances genuinely beyond her control (see Force Majeure), a pro-rata refund will be issued for any sessions not yet delivered.
Termination
Private clients:
The Coachee may stop the coaching relationship at any time by notifying Coach Amy in writing. The refund policy set out above applies.
Should the Coach need to stop the coaching relationship, a pro-rata refund will be issued for all sessions not yet delivered.
Corporate clients:
Termination terms for corporate clients are governed by the signed coaching proposal. No refunds are issued once the proposal has been signed, with the exception of force majeure as set out below.
Force Majeure
Coach Amy will make every effort to fulfill her obligations under any coaching agreement. In the event of illness, family emergency, or other circumstances genuinely beyond her control, Coach Amy will communicate this as soon as possible and will work with the Client to find a suitable solution, which may include rescheduling sessions or, in the case of extended unavailability, a pro-rata refund for the portion of the program not yet delivered.
Intellectual Property
All materials, tools, worksheets, journal prompts, assessments, and other resources created and shared by Coach Amy remain the intellectual property of Coach Amy. These materials are provided for the personal use of the Coachee only and may not be reproduced, shared, sold, or distributed without the prior written consent of Coach Amy.
Data Protection
Coach Amy processes personal data in accordance with applicable data protection legislation, including the General Data Protection Regulation (GDPR). Please refer to the Privacy Policy at coachamy.nl/privacy-policy for full details of how personal data is collected, used, and protected.
Jurisdiction and Governing Law
These terms and any agreements entered into with Coach Amy are governed by the laws of the Netherlands. Any disputes arising from or in connection with these terms shall be subject to the exclusive jurisdiction of the competent courts in the Netherlands. Clients based outside the Netherlands acknowledge and accept that Dutch law governs their agreement with Coach Amy.
In the event that any provision of these terms is deemed unenforceable, the remaining provisions shall remain in full force.
